maryland, and we have a winter weather advisory for the entire region, and it does not include om of this areas, but down to the river, there will be accumulating snowfall, but ladies, this is about the timing. this is going to the affect the morning commute, and schools and we are anticipating the delays, and ly go over it including the latest snowfall map in a moment. >> and now, the latest snowstorm will be able to be downloaded at any time. >> and the court's verdict in the road rage case in the case of a 63-year-old man. northern virginia man julie carey has come out of the courtroom, and what is the verdict? >> well, 20 minutes ago the jury found lee cena guilty of assault, but not battery in the deadly road rage incident that led to the death of 63-year-old william o'brien.

that is the jury's decision after four hours of deliberations in the case. c cena's attorney argued that he only wanted to gyell at him aftr he followed him into a parking lot as he had been constantly pa honking at him down the bridge road. this is the brief scuffle here on video when he followed him into the parking lot and k confronted him, but he says that o'brien threw the first punch, and he then punched back. now the two separated after witnesses told them to break it up. but two hours later when o'brien got home, he called 911 complaining to his head was about to the explode. and when the emergency crews got to the house, he was unresponsive and died ten years later. we heard the medical examiner say on the stand yesterday that he died after complications of blunt force trauma. cena's attorneys said it is a

tragedy, but not a crime, and that mr. cena acted in self-defense. but the jury seeing it differently finding him guilty of assault for causing fear to mr. o'brien, but not for battery, because they did determine that there was not a willful touching. the jury is back tomorrow at 110:00 in the morning the decide the sentencing phase, but this is a misdemeanor charge, and he can face a maximum of a year in jail and a $25 fine. we will have more coming up on new"news4 at 6:00" as the famil are leaving the courthouse. i'm julie carey for news4 report ing from fairfax county. and they thought they had found a way to beat the house. a couple today, in jail after using fake chips at maryland live casino. mark segraves reports that the police were able to recover more than $100,000 of these bogus chips found in an unusual place. >> security at maryland live

casino noticed the first fake chips last month. then virginia state police, and maryland police and investigators for homeland security working the case. in that investigation, they identified the $150,000 worth of counterfeit chips of this couple, and thigh tried to pass them. >> reporter: the couple bought them through the internet for $12,000, and then altered them to look like maryland live chips. one of the sus pects tried to get rid of the evidence by throwing them into the lake. police recovered over $115,000 of the chips floating right here. >> the chips floated and a n number of them were caught in the ice, and frozen into the ice, and the investigators chipped the ice away and brought the chips out. >> reporter: the police have charged the anadale couple with

multiple multiple charges of conspiracy to commit felony theft. it is the first time the counterfeit chips have been spotted in a maryland cosee know, and coming up at 6:00, why police think it is not an isolated incident and how it may have happened at another casino. a woman is dead after a bizarre accident. police say that the victim was walking down the hill on chesapeake street and edgewater when a parked car started to drift behind her. the car rolled over her and stopped on top of her, and the owner of the car did not see the accident, but backed up the vehicle to try to get it off of the woman, but the investigators say that the driver apparently didn't use the emergency bre break -- emergency brake. >> and another emergency, an ems worker was injured in a crash at kettering at the intersection of

202 and arbor way. the ems worker was driving through the red light with the sirens blaring when that crash happened. the ems crew was responding to a nearby townhouse that was on fire. and maryland students may have a better chance of finding out if they have been victims of the data breach. news4 just made a call to the credit monitoring hotline set up by the school, and we were able to get through after a five-minute wait. the hotline opened up at 9:00 this morning and the lines were jammed for most of the day, and this is amid revelations that the hackers stole birthdays and dates and social security numbers dating back to 1998, and the students are frustrated with the technical glitches. >> at this time, all circuits are busy now. >> reporter: what do you think of that? >> well, it is ridiculous. there are 350,000 people affe affected by this, and if the line is going to be busy all morn, it is not a defense at all against it. >> reporter: the hotline is going to be open until 9:00 tonight.

once you sign up for the credit monitoring, you can get a copy of the credit report and a free year of monitoring. and there could be more fallout over the massive target breach, because on capitol hill, the investigative committee is asking how long it took for them to tell customers their security had been breached. the house oversight committee says there is anecdotal evidence that shows that target knew about the breach before then. we have scott macfarlane with more updates at the live desk. the city's fire chief and deputy are called to step down by mayor wells after a failed response to helping a man having a heart attack outside of a d.c. fire station when the man came to ask for aid. they say that the deputy and the

fire marshall should resign, and there is mismanagement in the fire department that goes beyond one incident, and the mayor gray says this is nothing more than a political stunt. in the fight to legalize marijuana, there is a fight today. it starts in maryland where the top law enforcement agents from across the state are trying to snuff out the bill. chris gordon has the story. >> legalization is not the answer, and we will fight it to the very end. >> reporter: the battle lines are being drawn over the legalization of marijuana. the maryland sheriff's association will gather in annapolis to publicly affect their opposition. >> it affect's one ability to drive, judgment, and any reaction in the event that a small child or anyone would run out into the street in front of

everyone does, but that is what we are dealing with everyday driving down crime and illegal drug drug, and this legislation is troublesome. >> reporter: last year the maryland senate passed the bill decriminalizing marijuana, but it was defeated by the house of delegates. in annapolis, chris gordon. meanwhile in the district, d.c.'s top lawyer argued against it says that the federal law would still require the city to kick residents out of public housing if they are convicted of drug possession even if d.c. law no longer considered marijuana use a crime. but the supporters say that the attorney general has it all wrong. >> a single point of concern that has been raised by the office of the attorney general should not prevent the voters from deciding this issue. >> the booard is expected to gie its ruling and if approved the organizers have to collect more than 20,000 e petition signatures to get it on the

for the first time we hear from a school teacher who is scheduled to be sentenced next month in a child pornography case. >> and now we go to pat collins to see what he said in the

correspondent. >> this is signature eric j., t theooth, and in the letter he wrote to the judge who is going to sentence him in the case. by age 13, he said that he knew he was a pedophile. he writes, i knew that society considered people like me monsters. so i swore myself to secrecy and i would never tell anyone about my attraction to preadolescent boys. he was a third grade teacher at the prestigious beauovir on the national cathedral campus. he took pornographic pictures and video of kid s s in the sch bathroom using a camera disguised as a air freshner.

according to the court documents that went on from may 2006 to june 2008 when some of the pictures were discovered on a school camera, and eric tooth wept on the run. he faked the suicide, changed his appearance, and lived in homeless shelters and the first child predator placed on the fbi's ten most wanted list, and he was captured in nicaragua and brought back to washington where he has plead guilty to a series of child pornography charges. in his letter to the judge comes this apology. to my victims,d to all of the children and family trust i betrayed and whose lives i turned upside down, i can only reiterate and reaffirm both my guilt and remorse. now, toth has some definite

after-jail plans. they involve a country house, and a farm and some dogs. eric toth's post prison plans coming up at 6:00. live at district court, pat collins, news4. paramedics had to rescue a woman who slipped while jogging in rock creek park. she fell while it was snowing in melvin trails. and she hurt her leg. friends tried to get down to her, but they couldn't, because it was slick, and a rescue crew pulled her out and she was taken to the hospital where she is expected to recover. turning to the weather, and we will get sn act two? >> act two. >> and how cold tonight? >> well, that is the key, because most of the snow today melted on the roadways and most of it is melted on the grassy areas, too, and tonight, is a lot different than what we see even though it is the same storm, and it has to do with the timing and the colder air and taking a look outside toward reston, they saw 1 to 2 inches

out towards reston, and you don't see that on the ground, and right now, clear skies and sunshine. and out towards the airport looking a the sun and the sun isset tonight is around 6:00 where the current temperatures are sitting at 7:30, and winds out of the northwest at 9:00, and that is going to give us a little chill, but 37 in manassas, and 39 in fredericksburg. as the sun continues to set, the temperatures will go down fairly quickly and so that anything that develops overnight in the form of snow is going to stick immediately. and even on the roadways. that is the concern here. and team 4 radar shows snow to fredericksburg and down to the northern neck, and this is light, and no more accumulating snow. this is the way it was this morning. watch it develop here, and there was a good ban sitting up around portions of fairfax county, and springfield is the winner or the loser, and 3.5 inches of snow

and at the airport we have 2.8 inches of snow, and that is the third biggest snowfall of the year, and you will see the snow overnight, and through it at the future weather, 6:00 tonight, and snow showers out there, and leaving with the cold air in place, and by 11 tonight, most e areas will be below freezing and we will see the refreezing of the surfaces overnight, and watch yourself overnight, and by 9:00, notice the snow from quantico to fredericksburg and over here in the culpepper area, and the snow moving in with the colder temperatures. then 10:00, still snowing around the lower portions of the region. so it is a morning event, and that is why it is going to fkt the rush hour and also some school delays tomorrow. by 5:00 and just like today, some of us will see sunshine and on the cold side. the winter weather advisory in leesburg and fredericksburg, and snowfall affecting all of

southern maryland. and notice it is not going to affect winchester and hagerstown area. we think that the area that saw the bull's eye today will be the same. prince george's county, and anne arundel, and maybe slightly more, but a coating and up to an inch to south, and maybe down to hagerstown and winchester, but it is going to develop to the east of the mountains so only 1 to 2 in the d.c. metro area. and 40 degrees, a nice day thursday and still cold, but 28 and freezing friday, and 39 on saturday and another chance for light snow and light shower activity sunday in the form of rain at 48 degrees and then a much more significant storm possible monday. and right now, rain or snow, and that is the question with the highs in the 30s. >> it is supposed to be the happiest place on earth, but we will tell you why some folks are crying foul at disney.

some areas picked up 1 to 3 inches earlier today, and we could see the same in the day tomorrow and we are thinking 1 to 2 and that is why we have a winter weather advisory in d.c. and manassas and fredericksburg, but yesterday, we had a storm impact that was very low, because we knew that the roadways would be fine. tomorrow morning, a different story. we are up to medium as far as the impact, because we will see the delays likely and some roads

pren the scene by the robbers or if it is somewhere else that we can't see at this point. there are a lot of police here trying to figure out what happened, trying to find some witnesses to what we are told is the robbery of the united states postal service worker on duty while he was out delivering the mail in northeast washington this afternoon. i spoke to a representative from the postal service, and they say that they don't know what was taken from the care yes e and they are trying to put it together, and they have a postal inspector on the scene right here right now, and again, we don't know the conditions, but we know that we have had serious attacks on letter carriers here in the d.c. area, and it is something of contention among the carriers. they feel it is dangerous for them to be out in the evening hours. this happened while it was still broad daylight here behind this apartment building at 50 hawaii avenue in northeast washington avenue and the details are coming in. as we get more, we will get it to you.

live, jackie bensen, news4. and now back to the headlines, eric toth who was set to be sentenced in a child pornography case is asking for leniency. toth wrote a letter to the judge saying that he has known since a young age that he was a pedophile and tried to offer an apology to the victims. and a couple is charged with trying to cash in millions of dollars of poker chips last mon month. they say that the two tried to get rid of the evidence by dumping them into a lake in east springfield, but those chipped starts floating. and now top cops are here to urge lawmakers to the reject any measures that would legalize or decriminalize marijuana in the state of maryland. an elderly woman is the victim of an unthinkable crime. she is 95 years old, and police

say that someone broke into her home, and sexually assaulted her. >> it happened in riverdale, and the suspect is the still on the loose. the victim spoke to prince george's county bureau chief tracee wilkins, and she joins us. >> this woman's courage and strength is absolutely amazing. there was a little hesitation initially to have a conversation of what happened with her, but the reason she did it is because she wants to make sure that other folks in the community are vigilant and safe. >> reporter: how are you feeling now? >> shaky inside. insecu i am not safe. >> reporter: this 95-year-old woman whose identity we are protecting said that her life changed when a man entered her home and raped her. >> i was alerted to see a shadow of a man. i was sitting with the light, so i did not see too well, but there was a man there, and i came over to spoke to him, and

he chased me into the chair. >> reporter: she says he came through an unlocked back door. >> it was 9:00 at night, and always my doors are locked. >> reporter: it happened friday night in the 6100 block of 69 and riverdale. the victim who has lived in the home for 51 years tells me how she felt after being violated. >> why me? i felt misused. and powerless. >> reporter: prince george's county police went door to the door to talk with the neighbors and they are still trying to find the suspect, but they have a vague descriptis the message of other people your age? >> keep the house secure and the doors locked and the windows latched. that these people will try, and know how to get in. >> reporter:. >> the good news is that she has pl plenty of company now, and the

now at 5:00, we are learning more about what is going wrong with the silver line rail to dulles. >> news4 transportation reporter adam tuss is live in mclean with the update on the delays. adam? >> hey, pat. well, talking to the sources with direct knowledge of this project, it seems that we have just begun to scratch the surface with the issues of the silver lining, and i have to tell you that i have been looking through the procontract with the project, and the con track or the of the entire project could be facing serious penalties if they do not get this project finished on time. >> reporter: two weeks ago the contractor building the silver
